Summary:

The purpose of this program is to reduce or eliminate risk of eligible high hazard potential dams (HHPD). Funds will be made available to eligible states for pass-through to nonfederal governmental organizations or nonprofit organizations for the rehabilitation of HHPD listed in the National Inventory of Dams with a condition assessment of poor or unsatisfactory and dams in fair condition with a population at risk (PAR) at or above 1,000.

This program incentivizes eligible states to:

  • Provide financial assistance for repair, removal, or rehabilitation of eligible HHPD
  • Incorporate risk-informed analysis and decision making into their dam safety practice and HHPD rehabilitation investments
  • Incorporate risk-analysis results and information and consider all dam risk in state, local, tribal, and territorial mitigation planning
  • Promote community preparedness by requiring recipients to develop and implement floodplain management plans that address potential measures, practices, and policies to reduce loss of life, injuries, damage to property and facilities, public expenditures, and other adverse effects of flooding
  • Reduce costs associated with dam rehabilitation through the deployment of innovative solutions and technologies

Funds will support projects in the following two categories:

  • Project scoping, engineering, and design
  • Construction projects

Funds may be used for the rehabilitation of eligible HHPD or any other structural or non-structural measures to rehabilitate an eligible HHPD. For the purposes of this program, rehabilitation means the repair, replacement, reconstruction, or removal of a dam to meet applicable state dam safety and security standards.

Eligibility Notes:

Eligible applicants are states with a state dam safety program that is authorized by state legislation and a Federal Emergency Management Agency (FEMA)-approved state mitigation plan that includes all dam risks and complies with the Disaster Mitigation Act of 2000.

For the purposes of this program, the term state means each of the several states of the United States, the District of Columbia, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, the U.S. Virgin Islands, and any other territory or possession of the United States.

Each eligible state must designate one state administrative agency (SAA) to serve as the applicant, and each SAA may submit only one application to this program.

Regardless of which entity will implement the award, applicants must pursue this program in coordination with the appropriate state dam safety officer listed on pages 42-43 of the NOFA file and the appropriate state hazard mitigation officer listed online at www.fema.gov/grants/mitigation/state-contacts.

Eligible subrecipients are nonfederal governmental organizations, other than the designated applicant, and nonprofit organizations. Eligible subrecipients must apply for and receive subawards directly from the SAA and must meet the criteria detailed on pages 11-12 of the NOFA file.

  • Indirect cost agreement or proposal (if applicable)

Each program-specific form must be labeled and numbered, and the top of each document must include the state/agency name, "FY24 FALL HHPD," name and contact information, and date.

The following are required in order to submit an application:

  • Unique Entity Identifier (UEI) number
  • SAM (System for Award Management) registration
  • SPOC (state Single Point of Contact) notification

Applicants may obtain a UEI number and verify or renew SAM registration status at www.ecivis.com/sam. Applicants in states participating in the SPOC program must contact the relevant SPOC listed in the SPOC file before applying.

Applicants must provide at least 35 percent of the total project costs via nonfederal cash or in-kind contributions.

Funding Notes:

A total of $185.12 million is available to support an anticipated 50 awards through this program.

Funds will be made available to eligible states for pass-through to nonfederal governmental organizations or nonprofit organizations. Subrecipients may not receive awards in excess of $7.5 million. The allocation of funds will be calculated as follows:

  • Equal distribution: one-third of the funds will be distributed equally among states in which the projects for which eligible applications are submitted are located
  • Need-based: two-thirds of the funds will be distributed among states in which the projects for which eligible applications are submitted are located based on the proportion that the number of eligible high-hazard potential dams in the state bears to the number of eligible high-hazard potential dams in all such states

Funding selections are expected to be made no later than March 25, 2024, and awards are expected to be issued no later than April 8, 2024.

The project period is 36 months. Extension requests will be granted only due to compelling legal, policy, or operational challenges.

Up to 10 percent of the funds awarded may be retained by the state to be used solely for management and administration (M&A) purposes associated with the award. Subrecipients may also retain up to 5 percent of the funds passed through by the state solely for M&A purposes associated with the award.

Funds may not be used for:

  • Matching funds for any other federal awards
  • Lobbying
  • Intervention in federal regulatory or adjudicatory proceedings
  • Suing the federal government or any other government entity
  • Covered telecommunications equipment or services, as detailed on pages 26-27 of the NOFA file
  • Pre-award costs
