Summary:
The purpose of this program is to assist in the provision of domestic water supplies to existing tribal communities or households that do not have reliable access to domestic water supplies. At least 80 percent of the average annual deliveries of project water must be for domestic water purposes. Domestic water supplies are for human use and consumption, and domestic water supplies for communities include a communal benefit.
Projects may fall under the following categories:
- Planning studies, including environmental compliance
- Design projects, including environmental compliance
- Construction projects
One proposal may be submitted for planning and design. Construction projects must show that planning and design have been completed.
Eligible activities include the planning, design, or construction of:
- Installation of new tribally owned domestic water supply infrastructure facilities
- Improvement, upgrade, or inter-connection of existing tribally owned domestic water supply infrastructure and facilities
- Extension of existing tribally owned water supply infrastructure and facilities to reach an existing unserved or underserved service area
- Projects that assess and address urgent and compelling domestic water supply or quality needs
Projects may include the following types of infrastructure and facilities:
- Pumps, pipes, wells, surface water intakes and other diversion, transmission, or distribution systems
- Storage tanks and small impoundments
- Water treatment facilities for potable water supplies, including desalination facilities
- Buildings necessary to house equipment and serve as a center for operations
- Power transmission and related facilities required for the project
- Associated features to mitigate adverse environmental consequences of a project
Projects will be prioritized based on cost effectiveness, or the cost per household served, and the following urgent and compelling needs regarding access to reliable water, in order of priority:
- Receiving new piped water to homes
- Receiving new piped water to a nearby community watering station
- Improving water quality to meet drinking water standards
Eligible costs may fall under the categories of personnel, fringe benefits, travel, equipment, supplies, contractual, construction, other direct costs, and indirect costs.

Eligibility is limited to applicants with water delivery authority one of the 17 western states, including Arizona, California, Colorado, Idaho, Kansas, Montana, Nebraska, Nevada, New Mexico, North Dakota, Oklahoma, Oregon, South Dakota, Texas, Utah, Washington, and Wyoming.

Eligible applicants are federally recognized tribes or tribal organizations, as defined by 25 U.S.C. 5304(e).
Applicants must have water delivery authority in one of the 17 western states, including Arizona, California, Colorado, Idaho, Kansas, Montana, Nebraska, Nevada, New Mexico, North Dakota, Oklahoma, Oregon, South Dakota, Texas, Utah, Washington, and Wyoming.
An applicant may submit one application for both planning and design.
The following entities are ineligible:
- Non-tribal entities
- Entities identified in the System for Award Management (SAM) database as ineligible, prohibited/restricted, or otherwise excluded

- Barona Band of Mission Indians (CA)
- Ute Mountain Ute Tribe (CO)
- Pueblo of Pojoaque (NM)

The technical proposal section of the application must be formatted on consecutively numbered standard-size pages, with one-inch margins and a font size of at least 12-point. Oversized pages will not be accepted. Maps must be submitted as .pdf files.
The following are required in order to submit an application:

- SAM (System for Award Management) registration

There are no stated matching requirements for this program; however, applicants must detail any voluntary contributions and any third-party in-kind contributions costs that will be covered using program funding in the budget proposal.
This program will not fund projects, or portions of projects, where the scope of work and activities already have funding from a separate source.
Funding Notes:
Up to $320 million is available to support 3-15 grants or cooperative agreements through this program. Maximum award amounts and duration vary by project type, as follows:
- Planning studies: up to $3 million, with a one-year project period
- Design projects: up to $5 million, with a two-year project period
- Construction projects: up to $50 million, with a five-year project period
Award notifications are expected to be issued in fall 2024, and project periods are expected to begin in winter 2024.
This program will be implemented in two phases. Under phase one, funding will be available for planning and/or design, or construction in FY 2024. Under phase two funding will be made available for construction only in the FY 2027/2028 time frame. Receiving phase one planning and/or design funding is not a prerequisite for receiving phase two funding for construction; however, construction project must show that the planning and design has been successfully completed. Priority will be given to projects funded under phase one.
Funds may not be used for:
- Duplication of any other federal, state, or local award
- Water for commercial, industrial, and irrigation uses
- Water for future development
- Water to non-disadvantaged communities, as identified by the Council on Environmental Quality's Climate and Economic Justice Screening Tool (CEJST)
- Water for casinos, hotels, golf courses, or resorts
- Water required for fire flow protection
- Operations and maintenance of constructed infrastructure
- Projects that have been authorized by Congress
- Projects that have the potential to compromise any study or activities of a Department of the Interior reserved Indian water rights settlement activity, or the Department of Justice in its pursuit of related reserved Indian water rights claims
- Projects in direct support of litigation of any kind
