Summary:

The purpose of this program is to provide support for capital, net operating, and planning expenses to states and territories for ferry service to rural areas. Supported capital projects include the purchase, construction, replacement, or rehabilitation of ferries, terminals, related infrastructure, and related equipment, including fare equipment and communication devices.

Applicants supported through this program must have operated ferry public transportation service on a regular schedule at any time during the five-year period from March 1, 2015, to March 1, 2020, and operated at least one route segment of more than 50 sailing (nautical) miles between two rural areas. Support is also available for ferry service that serves at least two rural areas with a single route segment over 15 miles between the two rural areas that meets all other program requirements. Ferry systems that accommodate cars must also accommodate walk-on passengers to be eligible for funding.

Priority consideration will be given to projects that meet one or more of the following criteria:

  • Create significant community benefits relating to the environment, including incorporating low- or no-emission technology or specific elements to address greenhouse gas emissions as well as disproportionate negative impacts of climate change
  • Support workforce development, job quality, and wealth creation, as detailed on page 8 of the NOFA file
  • Support the Justice40 initiative, as detailed on pages 8-9 of the NOFA file

For facility projects, priority will also be given to projects that include elements to strengthen the resilience of the community and/or the transit system with regard to climate change.

Eligibility Notes:

Eligible applicants are states and territories in which eligible service is operated.

Applicants must document their eligibility by providing the following:

  • Documentation, such as dated and published sailing schedules, to demonstrate the operation of regular scheduled service at any time during the five-year period ending March 1, 2020
  • Documentation, such as route maps, to demonstrate provision of service for at least one direct segment between two rural areas that meet the distance requirement of either at least 50 or 20 nautical sailing miles during the five-year period ending March 1, 2020

Eligible projects are not required to be implemented on the same route segments that resulted in applicant eligibility.

The funding agency encourages applicants to notify the appropriate state departments of transportation and metropolitan planning organizations (MPOs) in areas likely to be served by the project. Supported projects must be incorporated into long-range plans and transportation improvement programs of states and MPOs before they are eligible for funding. The funding agency may take into consideration a project's consistency with, or inclusion in, such plans during the application evaluation process.

No more than one supplemental form will be accepted per SF 424 submission. The funding agency encourages states and other applicants to consider submitting a single supplemental form that includes multiple activities as one project to be evaluated as a consolidated application. If a state or other applicant chooses to submit separate applications for individual consideration, each application must be submitted using a separate SF 424 and supplemental form.

Eligible applicants may not have attributed data to an urbanized area in their most recent report to the National Transit Database for their ferry services.

In general, applicants must provide at least 20 percent of the net project cost via nonfederal cash and/or in-kind contributions. Applicants proposing planning projects must provide at least 20 percent of the net project costs.

For operating projects, there is no maximum federal share; however, applicants must provide at least 75 percent of the three-year average prior to the pandemic, which includes 2017, 2018, and 2019, on an annual basis to support ferry service for the period supported by this program

For projects that involve acquiring vehicles, applicants must provide at least 15 percent of the net project of acquiring vehicles, including clean-fuel or alternative fuel vehicles, for the purposes of complying with or maintaining compliance with the Clean Air Act (CAA) or the Americans with Disabilities Act (ADA) of 1990.

For projects that involve acquiring, installing, or constructing vehicle-related equipment or facilities, applicants must provide at least 10 percent of the net project cost of acquiring, installing, or constructing vehicle-related equipment or facilities, including clean fuel or alternative-fuel vehicle-related equipment or facilities, for the purposes of complying with or maintaining compliance with the ADA or CAA.

Additional consideration will be given to projects for which local funds have already been made available or reserved.

Eligible matching contributions include:

  • Cash from non-governmental sources other than revenues from providing public transportation services
  • Non-farebox revenues from the operation of public transportation services, such as the sale of advertising and concession revenues
  • Monies received under a service agreement with a state or local social service agency or private social service organization
  • Undistributed cash surpluses, replacement or depreciation cash funds, reserves available in cash, or new capital
  • Amounts appropriated or otherwise made available to a department or agency of the government, other than the funding agency, that are eligible to be expended for public transportation
  • In-kind contributions integral to the project
  • Revenue bond proceeds for a capital project, with prior funding agency approval
  • Transportation Development Credits (TDCs)
Funding Notes:

Approximately $216 million is available to support awards through this program. There are no minimum or maximum award amounts; however, applicants are encouraged to identify scaled funding options in case insufficient funding is available to fund a project at the full requested amount.

Of the total funding available, $20 million provided by the Consolidated Appropriations Act is available for entities that operate ferry service with a single segment of over 15 miles between two rural areas and meet all other program requirements.

Funds will be available for obligation for five years. Additional consideration will be given to projects for which funds can be obligated within 12 months of the award.

For operating projects, funds may not be used to replace existing state or local operating funds.

Funds may not be used for projects that have already incurred costs, unless the funding agency provides pre-award authority to incur costs, as detailed on pages 2 and 9 of the NOFA file, with the exception of any proposed continuation of projects funded from this program's FY 2022 or FY 2023 solicitations.

For FY 2023, a total of $170 million was distributed via six awards ranging from $400,000 to $92,786,400 through this program. For FY 2022, a total of $252.4 million was distributed via eight awards ranging from $1,345,241 to $72,065,545. Refer to the Award file for details.
